The Canadian Human Rights Act and The Ontario Human Rights Commission both recognizes Environmental Sensitivities as a Disability and sets out guidelines for inclusion of individuals within the workplace and public spaces. The OHRC has developed a very clear Policy and Guidelines on Disability and the Duty to accommodate.
Disability (as defined by OHRC)
The Code protects people from discrimination and harassment because of past, present and perceived disabilities. “Disability” covers a broad range and degree of conditions, some visible and some not visible. A disability may have been present from birth, caused by an accident, or developed over time.
There are physical, mental and learning disabilities, mental disorders, hearing or vision disabilities, epilepsy, mental health disabilities and addictions, environmental sensitivities, and other conditions.
In 2007, the CHRC commissioned two research studies: The Medical Perspective on Environmental Sensitivities by Margaret E. Sears (M.Eng., Ph.D.) and Accommodation for Environmental Sensitivities: Legal Perspective by Cara Wilkie and David Baker.
You may be aware that in 2011 the World Health Organisation classified electromagnetic fields of the kind used in mobile telephones as a 2B possible carcinogen. Health Canada has mandated the review of Safety Code 6 (SC6) by a committee of experts nominated by the Royal Society of Canada. Currently, the composition of the committee is being challenged under question of bias.
In the House of Commons, MP Terrence Young made an impassioned plea May 30th, 2013 for the removal of Bell telecom antennas from schools and residences.

- The USA has developed An Act To Create the Children's Wireless Protection Act to limit cell phone use by children. In the face of mounting evidence of increased risk for malignant brain tumors with cell phone use, including a recent Italian court case that was won proving cell and cordless phone use was the cause of a man’s brain tumor and the banning of sales and advertising of cell phones to children in the country of Belgium, Rep. Andrea Boland (D) Maine, re-introduces The Children’s Wireless Protection Act, a legislative bill to inform Maine consumers of the possible health risks associated with cell phone use.
- May 23rd, 2013, an Israeli cell phone company received a court order to compensate a customer who contracted cancer. Partner Communications, which operates in Israel under the name Orange, will pay NIS 400,000 (equivalent to $112,000 Canadian) to a customer
- who contracted cancer in his ear.
- February 28, 2013, the Administrative Appeals Tribunal of Australia awarded Dr. Alexander MacDonald to be paid compensation by his medical insurance provider, Comcare, after developing EHS after exposure to wireless devices in his position as a research scientist.
- Two years ago, the European Assembly passed Resolution 1815 , which, among other things, calls for restrictions on wi-fi in schools and the use of mobile phones by children.
